Dear Admin,

I hope this message finds you well. I am writing to formally report a profile on the forum for non-payment of dues.

Profile Details:

  • Username: Franke
  • Date of Transaction: June'24
  • Company Name: Connect Stuff B.V." (Clixarus).
  • Amount Due: 1,307.54 €
  • Details of the Agreement: Promoted their inhouse dating offers "HookupWithSluts - DOI - US [Responsive]" and "Date4Free - DOI - India", we've signed IO as well with them, Payment terms finalised by them were weekly however, it's been more than 3 months, they've not paid the amount and been continuously ignoring our messages.
Despite multiple attempts to reach out and resolve this matter directly, we have not received any payment or response from Franke. We've been following up on Email, Skype and Telegram, however, Frank is not responding even after coming online. This has caused significant inconvenience and concern.

I would like to take this opportunity to address the concerns raised by Simmi from BackStreetAffiliates regarding the non-payment issue connected to Clixarus and clarify my position in this matter.

First and foremost, I want to emphasize that I am not, nor have I ever been, a representative or owner of Clixarus.com. My role with Clixarus was strictly that of a freelance account manager, hired to manage specific campaigns, including those mentioned in the thread. The unfortunate reality is that I, too, was a victim of non-payment when Clixarus went out of business. Like Simmi, I was not paid for my final two weeks of work with them.

The offer that BackStreetAffiliates promoted—HookUpWithLocals.com—was a joint venture between Clixarus and DateCliq, overseen by Shelby MacRitchie. Shelby was responsible for the payment processing of this offer, but after Clixarus delivered results, she disappeared without fulfilling the payments owed to both Clixarus and its partners, including BackStreetAffiliates. This unexpected event led to the dissolution of Clixarus, leaving all of us in a difficult position.

I understand that my silence and lack of response, particularly after coming online, have caused significant inconvenience. I take full responsibility for that, and I want to extend a formal apology to Simmi and the BackStreetAffiliates team. My lack of communication stemmed from my own frustration with not being paid, which clouded my judgment in responding to your rightful inquiries.

That being said, I am now actively working to assist Simmi in any way I can to help recover the funds owed by Clixarus. While I do not have access to the company’s assets or legal authority to resolve this on my own, I am committed to supporting Simmi in retrieving what is owed.

I want to make it absolutely clear that Connect Stuff B.V., the company I currently work for, has no involvement in this matter. Clixarus was a separate entity, and I was merely a freelancer. Connect Stuff B.V. is only involved for accounting purposes, we did the bookkeeping for Clixarus. I deeply regret any confusion this situation may have caused, and I appreciate your understanding as we work toward a solution.

As we speak Simmi and I are in contact to discuss this further in private. Thank you.
 
A reasonable response to a deal gone bad. This is the way the way a pass-through payment agreement goes bad for reason that the first party seller is not financially solvent and responsible.

To the point: The importance of due diligence and assessing the financial health of partners in such agreements to avoid complications down the line cannot be overstated.

Good luck every seeing your money. If you have a person's name I found a reference to Draper, Utah US (Counties: Salt Lake, Utah) for that business name; might just be a dead end IDK.

As per the latest update from Franke, he worked as a freelance account manager for Clixarus. He is emphasizing that he is not responsible for payments, which Clixarus itself managed. With the company now defunct due to Shelby's disappearance, he cannot access its financial resources. For now, Franke is attempting to obtain contact details for Clixarus’s previous owner to recover our money.

However, our point here is that we don't want any third person to come into the picture and we discuss the matter with them, we want Franke to clarify everything and give us our payments.

Hate to tell you this, but you are probably in a no win situation. These affiliate networks (most anyway) operate in pass through agreements.
Franke is just an agent of an agent. Franke is not personally responsible your payment or for the principal's business and its failure to perform. If Franke had any money coming from his efforts with this vendor --it's gone too most probably or he has a very large charge-back pending ... I am not defending nor accusing anybody here. Hello reputation management team: We are all screwed, help!

These are the realities of dealing with international agreements (contracts) on the internet. Move on and try not to repeat the error. That said, you are going to have more write offs in business from fraud, bankruptcies, disputes that cannot be litigated in the furure --even if you act with due diligence and with all caution. Shit happens beyond your control sometimes.

Some of the networks these days actually provide that guarantee up front, especially after a good affiliate has established a track record and is making them some money. I don't know if Franke did.

True! However, it's very important that parties like Franke and DirectOffers work together to find an acceptable path for themselves to move on amiably. All of us in this business have been "stung" at some point (probably many times) and we have had to do our best to recover losses and do our best to continue on in our respective businesses without becoming caught up in the fray of "ill will" (IMO).

I am trying to help you out here, would appreciate it if you stop referring to me as not paying you. Lead Stuff & AdStuff, the companies I work for, process payments weekly. We have a proven track record which you can find on review sites such as Affpaying.

At the moment I am trying to contact the owner of Clixarus. I have send emails, Skype messages and have even sent a written letter to his known physical address. As you know they also own me personally money.

Once again, I am doing the best I can to get your invoice processed by them.

Agents are not financially liable for the actions of their principal's defaults; where there is no malice, fraud or breech of fiduciary on the agent's part in any transaction. Some of these pass-through deal go sour, without any remedy.

The agreement with the *plaintiff* is with the company you were an agent of.
I am assuming that it was a pass through for an agreement that Lead Stuff & AdStuff has (or had) with Clixarus.
Without seeing any contract, that would go beyond the pass-through payment, that is all I can say at this point.
  • Unless, the *plaintiff*, DirectOffersAvailable, can produce written promise of payment in the case of the default by the principal,
  • made by Lead Stuff & AdStuff, or you as is agent,
  • he must share his part of the loss.
